Giveaway Rules

1.  No Purchase Necessary to Enter or Win
Entry in the sweepstakes constitutes acceptance of these official rules.

2. Sponsor
The Long Island Rail Road Company (LIRR), Market Development, Dept. 1423, Jamaica Station, Jamaica, NY 11435

3. Eligibility
Open only to persons who, at the time of entry, are at least 18 years of age and are legal residents of the Tri-State area (New York, New Jersey and Connecticut). Employees, officers and directors of the Metropolitan Transportation Authority (MTA) and the LIRR, and their respective parents, subsidiaries, affiliates and agents, and the immediate family members (spouses, siblings, children and parents, regardless of where they live) and members of the same households (whether related or not) of such employees, officers and directors are not eligible.

4. Entry Period
Entries must be received between April 1, 2009 at 12:01 am (Eastern Standard Time) and December 31, 2009 at 11:59 pm (Eastern Standard Time). Participants need only enter once to be eligible for all drawings.

5. Method of Entry
Enter online using the entry form. Alternatively, individuals meeting eligibility requirements can enter by mailing a postcard with the entrant's full name, address and daytime phone number, including area code to: Long Island Rail Road, 175th Anniversary Customer Appreciation Giveaway Sweepstakes, Market Development, Dept. 1423, Jamaica Station, Jamaica, New York, 11435. All mail-in entries must be hand-printed in ink. All entries, whether on-line or mail-in, must be received by the first business day of the month following the offer to qualify for that month's prize. Limit one entry per person, regardless of method of entry. If multiple entries are received, only the first entry will be entered into the Sweepstakes and all other entries will be disregarded. LIRR disclaims liability for late, lost, misdirected or stolen entries.

6. Prizes (see Prize List)
There will be only one Prize awarded each month. The winner will be selected in a random drawing of all entrants. The drawing will be held on or about the 10th business day of each month. The decision of the judges is final. Entrants need not be present to win. Winner will be notified by the LIRR by email or by telephone within three (3) business days. Winner must meet all eligibility requirements and must respond back to LIRR within two (2) business days or an alternate winner will be chosen by random drawing. Odds of winning will be dependent on the total number of entries received. Prizes are subject to federal, state and local taxes, restrictions, surcharges, licenses and other fees and are the sole responsibility of the winner. Winner is responsible for providing to LIRR and the IRS all necessary information including but not limited to execution of forms required for appropriate tax treatment. An IRS Form 1099 may issue as a consequence of award. Failure to comply shall result in disqualification from the contest and an alternate winner will be chosen. Winner(s) will be required to provide proper proof of identify and sign an affidavit of eligibility and release. Failure to execute and return the affidavit and release within 5 calendar days from receipt thereof shall result in disqualification from the contest and an alternate(s) winner will be chosen.

7. General Conditions
Void where prohibited or restricted by law. Blackout dates may apply. Other restrictions may apply as dictated by theaters and/or other venues. All travel arrangements are the responsibility of the winner unless otherwise stated. If Winner is unable to fulfill prize during time period, Winner forfeits the prize package. Unclaimed and/or unused prizes will remain the property of LIRR and will not be awarded.

Prizes are not transferable and cannot be exchanged for cash. Entry constitutes agreement that entrant's name, photograph and likeness may be used for promotional purposes without additional compensation. The names, photographs and likenesses of entrants may also be published in Train Talk, a Long Island Rail Road customer publication, without additional compensation.

8. Limitation of Liability and Release
By entering this Sweepstakes, entrants agree to release, discharge and hold harmless the MTA, LIRR, Macy's Inc., venues or theater(s) providing prizes, and their parents, affiliates, agents, representatives and employees (collectively, “Releasees”) from any and all injuries, liability, losses and damages of any kind (whether direct, indirect, incidental, consequential, punitive or other damages) resulting from their participation in the sweepstakes, participation in any sweepstakes related activity, or their acceptance, use or misuse of prize including, without limitation, personal injury, death and property damage; and if a winner, to permit Releasees to use his or her name, photograph, likeness, statements, biographical information, voice, voice likeness and city and state address for advertising, trade, publicity and promotional purposes in all media, including but not limited to in TrainTalk, a LIRR customer publication, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Releasees are not responsible for and shall not be liable for [a] telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human or other error which may occur in the processing of entries, or the incorrect or inaccurate capture of entry information, or the failure to capture, or loss of, any entry or other information; failed, incomplete, garbled, interrupted, corrupted ,or delayed computer transmissions; printing, typographical or other errors; late, lost, garbled, misdirected, illegible or incomplete entries, or postage-due mail; or any condition caused by events that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel or suspend the promotion or any portion thereof should hardware or software malfunctions (such as but not limited to virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures) or other causes corrupt the administration, security or proper play of the promotion, in which case the prizes will be awarded via a random drawing from among all eligible entries received prior to the action taken, or in such other manner as deemed fair and appropriate by Sponsor. No prize transfer or cash redemption. No prize substitution except by Sponsor due to unavailability, in which case a prize of comparable or greater value will be awarded. Limit one prize per person. Entry information becomes property of Sponsor.

9. Winner's List
For the name(s) of the contest winner(s), send a self-addressed, stamped envelope to Long Island Rail Road, 175th Anniversary Customer Appreciation Giveaway Sweepstakes, Market Development, Dept. 1423, Jamaica Station, Jamaica, New York, 11435. Names of contest winners will be available on the first business day of the month following the prize award.

10. Miscellaneous
Long Island Rail Road reserves the right to change or cancel this contest at any time for any reason whatsoever.
